Mediation After Business Hours
After Hours Mediation provides mediation services outside the traditional workday for attorneys and parties whose schedules prevent participation during regular business hours.
The Mediation Process
-
1.
Pre-Mediation Review
Counsel provides pleadings, discovery responses, and position statements.
-
2.
Mediation Session
Conducted via Zoom or in person. Joint session followed by mediator-led negotiations.
-
3.
Resolution or Continued Negotiation
If resolved, a mediated settlement agreement is prepared and circulated. If not, and good-faith progress has been made, a mediator's agreement may be proposed. This oftentimes will get the case settled.
Why Mediation Works
Mediation allows attorneys and their clients to evaluate risk, narrow issues, and resolve disputes confidentially. The process is guided by a neutral attorney-mediator and avoids the cost and uncertainty of trial.
